LOCAL CODIFICATION of AGREEMENTS

 

                DRIVER DEPOT LINCOLN 2008

 

 

This document supersedes all previous codifications and must be used

in conjunction with the Drivers Restructuring Agreement 2005 and

associated supplements.

 

In the event of a particular issue not being covered by this

codification, the drivers diagramming, rostering and terms/conditions

agreement 2005 will apply.

1.  LINK STRUCTURE

 

1.1   The depot will consist of one link.

 

1.2  Drivers will be permitted to mutually exchange positions in the roster by applying in

       writing to management who will consult with the LLC.

 

1.3  New drivers to the depot will be allocated a position on the roster in consultation with

        the LLC. (The allocation of a driver to a vacant position will be done as to maintain an

        equal shift balance at all times).

 

 

2.  ROSTERING

 

2.1  Rostering of bank and public holidays other than Christmas Day and Boxing Day as per

       DRI rostering agreement.

 

2.2  Rostering of spare drivers will be by the nearest spare driver to the time.

 

2.3  Accommodation turns. Drivers who request temporary accommodation turns will be dealt

       with by agreement between the Driver Manager and Lincoln Drivers LLC. Drivers who are

       accommodated at their own request will take the hours of the turn they are allocated.

       This will be as near to the average working week hours as possible. They will allocated

       Sunday, no duty days as per their original rostered position, but not be available to work.

 

 

3.  EXCHANGING TURNS of DUTY

 

3.1  Drivers will be permitted to mutually exchange turns of duty subject to the following

       conditions:

 

3.2  The mutual exchange of duty must be in writing and signed by all parties and sent to the

       Roster Clerk.

 

3.3  Drivers who exchange turns of duty which includes a Monday and are rostered on the

       preceding Sunday, must be able to catch their Monday signing on time, otherwise the

       exchange will not be allowed. This applies unless they make themselves unavailable for

       the Sunday concerned. If the changeover includes a Saturday, which then makes the

       driver unable to catch their rostered Sunday the following day, they must make

       themselves not available for that Sunday. This to be done in writing to rosters.

 

3.4  When exchanging turns of duty both drivers will adopt the highest equalization total of

       the drivers available on that day for the purpose of no duty/Sunday working, this also

       applies to drivers who have a permanent exchange, but only on the week of the

       exchange.

 

3.5  All exchanges of duty must be submitted by midnight Sunday prior to the Thursday when

       the roster for the next week is posted. This can be done mutually at shorter notice

       between the roster clerk and drivers concerned in an emergency only.

 

3.6  Exchanges to be deemed as *Permanent irrespective of sickness/annual leave.

 

       *A driver will be considered as having a permanent exchange if:

  • An automatic exchange has been lodged with rosters
  • A driver exchanges for a regular pattern of AM/PM turns

 

 

4.  ALLOCATION of DRIVERS to SUNDAY WORK

 

4.1  Distribution of Sunday work. Drivers who do not wish to work their Sunday on a permanent

       basis must advise the roster clerk and Lincoln LLC and will be marked NA on the

       equalisation list. If the above driver subsequently decides to work their Sundays once

       again, they must advise the roster clerk and Lincoln LLC. They will then be given an

       average on the equalisation list, or their original total which ever is the greater.

 

4.2  All drivers [including long weekend drivers], [except as in clause 4.1] will be available to

       work their Sundays unless they indicate by midnight Sunday on the form provided at least

       7 days prior to the Sunday concerned. Long weekend drivers will only be rostered after all

       other means have been exhausted except for exchanges.

 

4.3  All drivers will be marked on the Sunday equalisation sheet as follows:

 

  1. Drivers who work a Sunday turn will be credited 1 turn.
  2. New drivers to the depot will be given an average.
  3. A record will be kept showing drivers names and total number of Sundays worked.
  4. All drivers totals will return to zero on the 1st Sunday in April and October.
  5. When the rosters arrive for the week by Thursday at 12:00, a driver who refuses to work a Sunday already booked upon the sheet will be credited with 2 turns and marked          ref x 2 on the appearance sheet.
  6. Any driver who is booked to work a Sunday under this agreement and then books off sick will be credited 1 turn and be marked ref x 1 on the appearance sheet.

 

4.4  When a driver is rostered to work a Sunday in the middle of their 2 weeks summer annual

       leave they will be considered not available.

 

4.5  Any driver failing to take duty on a Friday due to sickness will be removed from the

       Sunday roster and the turn allocated to the next in line.

 

 

5.  ALLOCATION of SUNDAY TURNS

 

5.1  Drivers who have a rostered turn which is cancelled will be treated as rostered spare and

       allocated a substitute turn 2 and a half hours either side of their original booking on time.

       If the substitute turn is shorter than the original, rostered hours will apply. A driver may

       only be rostered to work excess of the original time and hours by mutual agreement.

 

5.2  Drivers who are unable to be allocated in a turn in clause 5.1 will become spare taking

       their original time in hours, except by mutual agrement.

 

 

6.  ALL ADDITIONAL SUNDAYS to be ALLOCATED USING FOLLOWING

     GUIDELINES

 

6.1  The priority for allocation to turns will be drivers with the least number of recorded

       Sunday turns worked, then as follows:

 

6.2  If there are two or more drivers on the same total and not enough Sunday turns to cover

       this will then be done in seniority order, subject to time availability.

 

6.3  If there are or more diagrams to cover but insufficient drivers available, the drivers will

       be given the longest turns, subject to time availability.

 

6.4  If there are equal diagrams to cover as there are drivers available, this will be done

       subject to time availability.

 

 

7.  ALLOCATION of DRIVERS TO NO DUTY DAYS

 

7.1  Drivers who work a no duty day will be credited 1 turn.

 

7.2 New drivers to the depot will be given an average.

 

7.3  A record will be kept showing drivers name and total number of no duty days worked.

 

7.4  All drivers totals will return to zero on the 1st Sunday in April and October.

 

7.5  When the rosters arrive for the week on the Thursday, any drivers who refuse to work a

       no duty day already allocated upon those sheets will be credited 2 turns. If after that time

       the sheets are amended and the driver is booked or asks to work their no duty day, if they

       refuse they will not be credited, unless at least 72 hours notice is given prior to start of

       turn to be covered. Whereupon the driver concerned will be credited 1 turn.

 

7.6  The priority for allocation to turns will be drivers with the least number of recorded

       no duty totals, then as follows:

 

 

  1. If there are 2 or more drivers on the same total and not enough no duty turns to cover, this will be done in seniority order subject to time availability.
  2. If there are two or more drivers to cover but insufficient drivers available, the drivers concerned will be given the longest turns subject to time availability and route knowledge.
  3. If there are equal diagrams to cover as there are drivers available this will be done subject to time availability.
  4. Drivers who have exchanged turns of duty will adopt the highest equalisation total of the drivers available on that day and then as clause 7.6 1
  5. Any driver who is booked to work a no duty day and subsequently books off sick will be credited 1 turn for each no duty day concerned and marked ref x 1 in the no duty block on the appearance sheet.
  6. If any driver refuses a no duty day after being rostered in accordance with this agreement should be marked ref x 2 in the no duty block on the appearance sheet. But if a driver refuses a turn for which less than 72 hours notice is given from the start time of the diagram to be covered, it should be marked NA and these drivers will not be credited as having worked a turn.
  7. Any driver booked to work a no duty day and is subsequently removed by rosters, must be given 48 hours notice or will become spare at the original rostered time.
  8. No driver to resume off sick to work a no duty day.

 

8.  ANNUAL LEAVE

 

8.1  The annual leave roster will be drawn up by Lincoln LLC and agreed with management,

       this will then be posted by 31st October for the following year.

 

8.2  The maximum number of drivers that can be on annual leave (whether rostered or by

       individual application) at any one time shall be determined by the formula within DRI.

 

8.3  Summer leave will commence on the 3rd Monday in April and will run for 26 weeks in

       fortnightly blocks numbered 1 - 13.

 

8.4  One weeks early leave will be rostered over the 13 weeks prior to summer leave.

 

8.5  One weeks late leave to be rostered over the 13 weeks after the summer leave.

 

8.6  Maximum numbers of drivers in each block will be determined by DRI.

 

8.7  The blocks will rotate as follows:    1 - 7 - 2 - 12 - 3 - 9 - 4 - 10 - 5 - 11 - 6 - 13 - 1

 

8.8  Mutual exchanges will be permitted. Vacancies maybe applied for but must conform to

       clause 8.2 and will be agreed with Lincoln LLC and rosters office.

 

8.9  Applications prior to the 31st December for vacant summer blocks must take the full

       2 week period; preference will be given to drivers in blocks 1 & 13. From 1st January

       drivers will be allowed to take 1 week in any summer block in accordance with clause 8.2.

 

8.10 No drivers will be allowed to move to a vacant block until drivers in blocks 1 & 13 have

       had a chance to change; this will be done by posting.

 

 

9.  SICKNESS

 

9.1  Drivers resuming duty after sickness must give a minimum of 9 hours notice prior to their

       rostered booking on time. Such drivers will cover their own turn and the driver booked to

       cover will become spare for the hours allocated for that turn, except where a No Duty

       worked driver has been rostered to the turn, then the resuming driver remains spare.

 

9.2  Any driver failing to take duty on a Friday or Saturday due to sickness will be removed

       from the Sunday roster and the turn allocated to the next in line.

 

9.3  Long term sick drivers who are unable to work Sundays or no duty days will be allowed an

       average until the list returns to zero on the 1st Sunday in April and October. At that time

       the depot average will be calculated and if the driver falls short of this figure, their total

       will become the difference between the two shown as a minus figure. At the time of the

       equalisation list becoming zero they will then be allowed the next six months to catch up.

 

 

10. RELEASE of STAFF FOR UNION DUTIES

 

10.1  Staff will be released for union duty as per the 1992 procedures.

 

 

11. AFTER REST

 

11.1  If any driver is booked a turn which interferes with their next day turn of duty, they will

         classed as "After Rest".

 

11.2  After Rest drivers will resume to their booked turn if at all possible, otherwise they will

         be identified as spare until their rostered booking off time, unless a No Duty worked

         driver has been allocated to the turn, in which case the After Rest driver remains spare.

 

11.3  If less than 2 hours duty would be worked in order that the following turn can be worked

         without alteration to booking on and off hours, the driver will be booked off with no loss

         of pay.
